Appeals

The Derbes Law Firm, LLC handles appeals in a variety of venues for their clients. Our team has handled several appeals at the state court level in the Louisiana Fourth Circuit (which includes Orleans Parish) and the Louisiana Fifth Circuit (which includes Jefferson Parish), and practices in all of the Louisiana appellate courts. The firm also has Federal appellate court experience, including appeals of bankruptcy court decisions to the United States District Court for the Eastern District of Louisiana. The firm handles administrative appeals and appeals from tax court. On occasion, members of our team have handled appeals before the United States Court of Appeal for the Fifth Circuit and has successfully fought a writ of certiorari to the United States Supreme Court. The firm’s appeals team relies on its diverse knowledge and extensive commercial experience when handling your appeal.

Employment

The Derbes Law Firm’s representation of both businesses and employees informs its representation of each. The firm’s extensive business law experience provides the firm with insight into employment-related issues that may arise in your business. For example, the firm prepares employment-related documents for businesses, such as non-compete agreements and employment contracts. While Louisiana is an at-will employment state, the firm can evaluate and handle possible wrongful discharge and Fair Labor Standards Act (FLSA) claims representing either the employee or employer. Such wrongful discharge cases include age, sex, and racial discrimination cases in federal and state court. We also advise employers and employees in connection with the Worker Adjustment and Retraining Notification Act (WARN). 

Mediation

Albert J. Derbes, IV is a mediator listed with the Louisiana State Bar Association’s ADR Civil Mediator Registry, having completed 40 hours of civil mediation training. His extensive experience in business transactions, commercial litigation, and bankruptcy provides a solid foundation for successful mediation regarding commercial and insolvency matters. His understanding of both the risks and rewards of litigation coupled with his transactional experience, allows him to help the parties to the mediation arrive at a pragmatic and cost-effective resolution. Mr. Derbes performs mediations either in person or by video conferencing software.
